01Acceptance & Eligibility
By accessing or using Craps@Home (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms.
You must be at least thirteen (13) years of age to use the Service. If you are between thirteen (13) and seventeen (17), you may use the free portion of the Service but you may not subscribe to Pit Pass.
To enter into a paid subscription with Pit Pass, you must be at least eighteen (18) years of age and have legal capacity to form a binding contract.
02Nature of the Service
Craps@Home is a statistical and recordkeeping tool designed to help users track the outcomes of dice rolls at their own private craps games. It calculates roll counts, point hits, hot numbers, and similar statistics from inputs you provide — either by voice or manual entry.
What the Service Is Not
- The Service is not a gambling platform, sportsbook, or wagering application.
- The Service does not accept, hold, transmit, or pay out wagers.
- The Service does not generate random numbers used for gambling, predict outcomes, or guarantee any result.
- The Service does not provide gambling advice, financial advice, or strategic guidance.
- Tips paid through the Service go to the developer of the application as a gratuity for the software, not to any dealer, casino, or gambling participant.
You are solely responsible for the legality of any gambling that takes place at your own table. Laws regarding private gambling vary by jurisdiction. The Service is offered for informational and entertainment purposes only.
03Account & Local Data
The Service does not require you to create an account to use its core features. Player names, photos, leaderboard data, game history, and preferences are stored entirely on your own device using your browser's local storage.
You are responsible for your local data. Clearing your browser data, uninstalling the app, or switching devices may permanently erase this information. We do not back up, restore, or have access to data stored on your device.
Pit Pass subscribers are identified by their email address through Stripe. Subscription state is managed by Stripe and is described in Section 07.
04License & Permitted Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.
This license does not include the right to: (a) resell or commercially exploit the Service; (b) use the Service on behalf of any commercial gambling establishment without separate written permission; (c) use any data mining, scraping, or similar tools to extract content from the Service; (d) reverse engineer, decompile, or attempt to derive the source code beyond what is permitted by applicable law; or (e) remove any copyright or proprietary notices.
05Prohibited Conduct
You agree not to:
- Use the Service in connection with illegal gambling or any activity prohibited in your jurisdiction
- Use the Service to facilitate, manage, or record commercial gambling operations without our written consent
- Attempt to interfere with the Service, including by overloading, attacking, or probing it
- Impersonate any person, misrepresent your affiliation, or attempt to gain unauthorized access
- Upload or input content that is unlawful, harassing, defamatory, or infringes the rights of others
- Use the Service to upload photographs of any person without that person's consent
- Bypass or attempt to bypass any access controls, including the easter-egg PRO unlock or Pit Pass subscription
06Tips
The Service offers an optional tipping feature in fixed amounts of $2, $5, and $10. Tips are processed by Stripe and paid to Niventure Group LLC. Tips are gratuities to support development of the Service.
Tips are non-refundable. Once a tip transaction is completed, it cannot be reversed except as required by applicable law or as authorized at our sole discretion in cases of clear error or fraud.
07Pit Pass Subscription
Pit Pass is an optional, recurring subscription priced at $4.99 per month, processed by Stripe. It is intended for early adopters who wish to support continued development of the Service and to receive early access to PRO features as they are built and released in beta.
What Subscribers Receive
Pit Pass is a support tier with the following intended benefits, provided on a good-faith, reasonable-effort basis and which may evolve over time:
- Early access to PRO features in beta. As new PRO features are built and ready for limited testing, Pit Pass members receive access before general release. Beta features may be incomplete, may change, may be removed, and are provided "as is."
- A direct support channel. Pit Pass members may contact the developer at the support email and can expect a good-faith effort to respond. This is not a guaranteed-response, 24/7, or service-level-agreement-backed support tier.
- Insider updates. When meaningful product news exists to share, Pit Pass members are notified before public announcement.
The pace, scope, and exact form of these benefits are determined at our sole discretion. Roadmap items, beta features, and update cadence are not contractual deliverables. Subscription fees are not contingent on any specific feature being shipped within any specific period.
If we materially change the benefits offered to Pit Pass, we will provide reasonable notice by email and you may cancel without penalty.
08Auto-Renewal & Cancellation
By subscribing to Pit Pass you authorize Niventure Group LLC, through Stripe, to charge your payment method $4.99 every month until you cancel. Each billing period begins on the day of the prior charge.
You may cancel your subscription at any time:
- Through the Stripe Customer Portal, accessible from the Service's Settings panel
- By emailing contact.crapsathome@niventure-group.com
Cancellation takes effect at the end of the current billing period. You will retain access to Pit Pass benefits through that date. You will not receive a prorated refund for any unused portion of a billing period.
If your payment method is declined, we may suspend or cancel your subscription. Stripe handles failed-payment retries and notifications.
09Refund Policy
All payments are final and non-refundable except as required by applicable law. This applies to both one-time tips and Pit Pass subscription payments.
If you believe a charge was made in error, please contact us within thirty (30) days at contact.crapsathome@niventure-group.com. We review refund requests in good faith but reserve the right to decline.
10User Content
You retain all rights to content you input into the Service, including player names and photographs (collectively, "User Content"). Because User Content is stored only on your device and is not transmitted to us, we do not claim any rights in it.
You represent and warrant that any User Content you input does not violate the rights of any third party, including privacy and publicity rights. If you input a photograph of any other person, you confirm you have that person's permission to do so.
11Intellectual Property
The Service, including its design, code, branding, "Craps@Home" name, "Pit Pass" name, illustrations, sound assets, and all related materials, is owned by Niventure Group LLC and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership to you.
The terms "craps," "snake eyes," "yo-leven," and other gambling vocabulary are common terms used in the dice gambling tradition and are not claimed by us.
12Third-Party Services
The Service relies on third-party services including Stripe for payments and Cloudflare for hosting. Your use of those services is governed by their own terms and privacy policies.
The Service may link to other websites or resources. We are not responsible for the availability or content of those external resources.
13Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, accurate, or complete; that any defects will be corrected; that the Service will meet your requirements; or that statistics, calculations, or roll histories produced by the Service are free of error. You should not rely on the Service for any decision involving money.
Voice recognition is provided by your browser and may produce inaccurate results. You are responsible for verifying any data the Service records.
14Limitation of Liability
To the maximum extent permitted by applicable law, in no event will Niventure Group LLC, its officers, members, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, statute, or any other legal theory, and whether or not we have been informed of the possibility of such damage.
In any event, our aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amounts you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred united states dollars (us$100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the above limitations apply only to the extent permitted by law.
15Indemnification
You agree to defend, indemnify, and hold harmless Niventure Group LLC and its officers, members, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including reasonable attorneys' fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including any privacy, publicity, or intellectual property right; or (d) any User Content you input.
16Termination
You may stop using the Service at any time. If you have a Pit Pass subscription, see Section 08 for cancellation.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including for violations of these Terms. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination — including Sections 11 (Intellectual Property), 13 (Disclaimers), 14 (Limitation of Liability), 15 (Indemnification), 17 (Governing Law), and 19 (General) — will survive.
17Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Orange County, Florida. You and we consent to the personal jurisdiction of those courts and waive any objection to venue.
18Changes to These Terms
We may modify these Terms from time to time. The "Effective" date at the top of this page indicates when the Terms were last revised. Material changes will be highlighted in the app or, where reasonably possible, communicated by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
19General
Entire Agreement
These Terms, together with the Privacy Policy and any other notices we provide, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
No Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms freely.
Force Majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, acts of war, infrastructure outages, or other events of force majeure.
